    Complaint:

    Comment: Complaint #200447053 - Colorado Division of Water Resource Location: NE Q NE Q section 8 township 22S Range 58W. Location ID: 436291. API # 05-025-06020. Padilla #1, location ID 436291 Issue: Two ponds remain after they drilled a well around the date of March 2014. The well has been plugged since but the two ponds remain. These ponds are pond pits and are not in compliance with our stock water pond descriptions. These ponds must be pumped out, drained and backfilled due to this area being in a drainage that is tributary to the Arkansas River. The west pond does not go dry and is probably receiving groundwater. The East pond is partially lined doesn't hold much water. All runoff and storm runoff currently run into these two ponds which needs to go back to the river. Even if Mr. Padilla would want these two ponds for stock watering, it would not qualify under the rules for a stock water pond. No headgate or dirt dam to release all water and drainage must be dry 80% of the time during the year. These two ponds are not in compliance with the groundwater rules of the Arkansas River Basin Rules.

    Final Comment: The two drilling pits have not been backfilled and reclaimed. One pit has torn pit liner debris that must be properly removed and disposed. Water remains in the pits and must be pumped out to sufficiently dry the pits. Pits will need to be closed and sampled per 900 series rules. There are ditches directed toward the pits that must be filled in. There is a lack of vegetation at the location and soils are susceptible to erosion. There are undesirable weeds throughout the location. All backfilling of pits, recontouring, soil decompaction, and reclamation must be completed by April 30, 2019. Corrective Action does not preclude from enforcement action.
