Co workers from the day before told me about an explosion in which 2-3 workers were possibly injured, I don’t know the full details of the explosion. My problem is that before explosion workers were not trained as they should’ve been and worse after the incident employee and oil company placed me and other employees in the exact area. We had no safety discussion, we know little about the explosion what happened and why. Over and over and over the chair asked the audience to please be respectful, not make comments, etc. HE COMPLETELY LOST CONTROL OF THE ROOM. He needs to do his job and enforce order for all of us who come to testify. Evict those who will not follow the rules. If the COGCC wants to be respected then please get it under control Mr. Chair.   • Date Received: Aug. 4, 2019 Document No.: 200447856 ROYALTY Operator: Invalid Operator Facility: Description: Hello, Extraction oil and gas company has been deducting money from my royalty check and it was MY understanding that NOTHING was to be deducted from my forced pooled, non-conforming 12.5% payment and that all 'fees' etc...were taken out of the 87.5% PENALTY -that the oil and gas people are KEEPING because I did not lease! I sent them the information I received from various places....one being "If you have been involuntarily pooled already, you are not expected to pay any of the costs . All expenses and the statutory 200% comes out of any proportionate share you are due from your percentage of the pool. That will be taken first, then you will start receiving payments for your mineral interests. as well as the 12.5 (1/8%)." They said they have to keep taking it out until the finish 'investigating' it. I feel like a neglected relative and am very upset....I am an elderly widow with a fixed income that was cut in half (but my debts were not cut in half) when my husband died...$400 may not seem very much to them but it is very important to me....especially when it is taken out twice...once from the royalty (12.5) and once from production (87.5%). I sent Extraction some of the information I had regarding no deduction from my 12.5% royalty. "If you have been involuntarily pooled already, you are NOT expected to pay any of the costs . All expenses and the statutory 200% comes out of any proportionate share you are due from your percentage of the pool. That will be taken first, then you will start receiving payments for your mineral interests. as well as the 12.5 (1/8%) Royalty. This is all assuming the well is profitable.   • Date Received: Aug. 1, 2019 Document No.: 200447846 NOTIFICATION Operator: Invalid Operator Facility: Description: Location: West of Colorado Blvd between 151st Ave and Jackson St Brighton Colorado 80602 Issue: Noble Energy sent a "Notice of Scheduled Activity" to my home. It said they were plugging 2 wells in this area. Unfortunately there are 3 in the described area. I called the phone number on the letter (1-844-224-0347) and reached someone in Texas who could not help me. He transferred me to a second person, who also could not help me, and referred me to a phone number (800-220-5824) which was an automated system with no reference to Colorado operations. Google gave me a Denver office number and a Greeley office number. Denver was not able to direct me at all. Greeley was going to look up the manager for my area and have them give me a call. This is ridiculous, and in my opinion does not meet the standard for notification. Resolution: COGCC rules to do not require notice for this activity, so the notice is provided as a courtesy. COGCC does not regulate the content or accuracy of the letter. The operator may not be abandoning all wells in the vicinity.

I have lived in Beijing, China which has had polluted air and I know how pollution affects me. My health is being affected by the air quality. My respiratory health is getting worse due to the increase in bad air quality. It feels like I always have a low grade cold- my throat is scratchy and dry. My throat feels the same as when I lived in China! I am a healthcare provider and I know I am not sick with a cold- I am 100% certain this is because of the pollution getting worse. Issue: Need to confirm that the formula for calculating our mineral royalties is correct and that we are receiving our correct dollar amount. An article in Law360 (March 18, 2019) stating that "A Colorado federal judge approved a nearly $8 million settlement that will go to a class of roughly 600 royalty owners who alleged they were underpaid by a unit of gas producer Terra Energy Partners LLC..." I have no way of knowing if the interest rate or if the formula used to calculate our royalties due us are correct. And after seeing the above article, I would like it to be confirmed that the formula and what we receive for the royalty on our above wells are correct. Something is loose on them that causes them to rattle and shake everytime they hit a bump. It's awful for the handful of residence along main st. Either offer to buy us all out for a residential area for your drivers/energy workers or bypass main. The sheer number of trucks is rediculous. PLEASE at least fix the rattling issue with the sand trucks. I can send a video if you like. Resolution: Traffic noise is not within COGCC's jurisdiction. Complainant referred to local government.

TRAFFIC-Fracking Increases Truck Traffic- More volume on busy neighboring roads. Before/after school traffic with this can be a possible nightmare, we will have industrial equipment visible, water pits and these sites emit smog-forming volatile organic compounds and benzene. 2. LIGHTING-Bright light flares as this site will have a constant flare emitting (methane leaking, etc.) 3. PROPERTY VALUES-Property Values will decrease?- Example: All the houses on the market at HWY 7 & I-25 and Erie/ N. Broomfield since the Great Walls of Fracking went up they have decreased. Who will want to buy our homes with noise pollution, Mountain View obstructed by Fracking Towers/$125,000 2 month wall, next to the “Frack Freeway” when they know the risk factors to their health nearby them. 4. SCHOOL DRILLS-Safety- this will be another School Drill for our kids to prepare for if there was a leak or explosion that happened. 5. WATER-Chemical-laced wastewater can spill and pollute drinking water. If there is a leak this can contaminate our water which we already know Commerce City struggles with and create harmful health issues. Water mixture that pumped into the shale rock during the fracking process contains carcinogenic chemicals, these escape fracking boreholes and pollute the local water supply near the fracking site which is our homes! Also Fracking requires more water than conventional gas drilling generally 1-8 million gallons of water, this can cause increases on our rates and decrease us having life giving water to survive from due to the supply and demand. 6. CHEMICALS-The mixture used in fracking often includes additives of biocide, polymeric lubricant, surfactant, and stabilizer. But because companies are not required to disclose any information about the chemicals they use, they have the freedom to change the ingredients. This is especially true because they are exempt from the Safe Drinking Water Act of 20 Resolution: COGCC does not accept objecting to pending permits via the complaint process.   • Date Received: July 15, 2019 Document No.: 200447818 AIR QUALITY Operator: Invalid Operator Facility: Description: Extraction has been using Gibson D822 which contains benzene, toluene, ethylbenzene and polycyclic aromatic hydrocarbons. This oilly liquid is a carcinogen and also contains ozone precursors. This drilling mud is used by the truck loads. I have experienced all the heath effects symptoms listed on the SDS. In addition, I have also experienced massive hair loss which stopped immediately after drilling stopped. One day I had massive diaherria (as in a free colon cleanse for a colonoscopy) after breathing the Gibson for hours the day before. Because I have had all the short term health effects should I assume I will have the long term effects such as cancer? I have made the CDPHE aware of this and they could take no action. What can be done for myself and my neighboors which includes children? Broomfield also misrepresented the electrical power situation to the CDPHE and told then Interchange did not have electrical power yet an electric drill was used for almost three months. How can COGCC allow oil and gas to use Gibson D822 in neighboorhoods and expose people to this carcinogen when NEOFLO is available? The CDC and the EPA tell me that benzene, toluene, and ethylenebenzene are first detected by the human nose around 1.5 to 5 or 6 ppm. The problem is that the health standards (ATSDR) are 1000 times smaller in the <10ppb range. When the COGCC inspector or Broomfield inspectors come out and sniff the air their nose is not adequate to provide quantification of these carcinogens in the ppb range. When their noses start to detect the chemicals it is 1000 times over the health standard. What we were smelling was not something that was barely detectable. It was very very strong and I am concerned the concentrations in the air where much much more than ppm. The CAMML should have been at Interchange B but it appears Broomfield did not want them there and told them there was electrical power. The CDPHE can do nothing for us. Can you do anything to access the damage to our bodies. On 9/21/2019, I contacted the complainant via phone who informed me the midstream company performing the work “Rocky Mountain Midstream” had since responded to his complaint and have moved the tanks that were staged on his property. CLOSED COMPLAINT PER COMPLAINANT REQUEST No violation of COGCC rules were observed at the time of the inspection. All information reviewed and site inspection information were submitted to the complaint specialist for further review.

The HOA claim we are NOT to engage business in which case this would be one. our guidelines does not support it.furthermore they state if there would be any suit against in this case the operator, Aspired, i could be included in it. therefore, please take notice that i have no interest in this whole ordeal. i also received another package from Wellborn Sullivan Meck & Trooley, PC who i believe they represent Axis Exploration LLC,(aplicant). i believe aspired wants me to lease my mineral rights to them, i have little knowledge on the outcome, but if there was any issues of polution in the water, gas or oil leaks, or simple the presence of an oil pump, i would be very concern; the fact that we are not to do business in our community, the chances of having part in a law suit, I rather stay out. thank you. Police report case #19-0858 with officer Aaron Haddox on 5/2/2019. Issue: Seismic testing devices from Crestone Peaks were left in a children’s park with no identification or coverings so children could not touch them and get hurt. Children of all ages play in this park daily. Resolution: COGCC referred the complaint to the LGD for the town of Erie. The town is the surface owner.

Directly across the street (west) is Crescent Park. Issue: Today, unidentified metal boxes with wires from each end coming out appeared. I called the police and the almost sent out the bomb squad. The local police called to say these are showing up everywhere. Without notificiation, without any identification.This has to be violation of some rule if in fact these are a result of some oil & gas work.Can they place unidentified metal boxes with wires in public parks with no notification? The prudent action would be to have a bomb squad remove them. Or a citizen might. Resolution: COGCC referred the complaint to the LGD for the town of Erie. The town is the surface owner.
  • Date Received: April 30, 2019 Document No.: 200447215 ROADS Operator: Invalid Operator Facility: Description: I witnessed a semi truck leaving an Oil & Gas site that turned northbound on CR 7, just north of the CR 7 & CR 4 intersection. The semi traveled north until they reached the intersection of CR 7 & Erie Parkway. The semi was attempting to make a right hand turn onto Erie Parkway from CR 7. The speed limit on Erie Parkway is 50 mph, just to be clear. The semi was unable to make the turn while staying in their lane, and they not just occupied the southbound lane on CR 7 while attempting the turn, they proceeded to turn into all lanes of traffic on Erie Parkway, stopping traffic in all directions. This is not the first time I have seen this happen, and I have personally had to slam on my brakes and come to a complete stop to avoid semi's making similar moves. There is an even bigger concern here. This intersection is 1 block away from CR 5 & Erie Parkway, where Erie High School and Soaring Heights PK-8 is located. I drive past this intersection every day to take my child to school, along with all of the teenage drivers going to Erie high school. This is a traffic incident waiting to occur and someone is going to get killed. There is no good reason to send your haulers down a road that they are physically unable to make the turn. The traffic control plan that was submitted for this drilling permit needs to be re-examined, because I feel like someone absolutely dropped the ball here. I REPEAT. YOU CAN NOT allow your truckers and haulers to use a road where they CAN NOT PHYSICALLY make the turn without putting other drivers at risk. My kids and I could not spend time outside after dinner due to the smell. Resolution: COGCC Inspection Report Summary On 4-10-2019 at approximately 0800 hrs. I, Inspector Jason E. Gomez, conducted a field inspection in reference to an odor complaint in the Erie area in the neighborhood of Vista Ridge, in Weld county Colorado. While in the area, I observed a drilling operation at the Extraction Coyote location, a 4 production operations in the area. During this inspection of the neighborhood and neighboring oil and gas operation no odors issues were observed off the locations. The extraction drilling operation were using mitigation measures to mitigate odors from their location at the time of the inspection. No compliance issues were observed at the time of the inspection.

Issue: Since the cryogenic plant was finished the semi traffic through Market Street as well as when the workers get off work has gotten unbearable. The excessive use of Jake brakes 24/7 because many the semis are going way over the speed limit to make the turn. No doubt some of them do it just to be cute. Market Street is 30 mile an hour and flat, it is not a mountain Road which is what Jake brakes were designed for. When the workers get off work they like to use Market Street and the county road as a drag strip to show off their big diesel pickups they go by my house and rattle the windows with no regard or care to anybody including children. As a sufferer of PTSD and cluster headaches this has made my life unbearable. I understand the need for your plant and have been understanding as best as I can, how about helping out and being fair with people that have to live here. Resolution: The facility described in the complaint is not within the jurisdiction of the COGCC. The complainant was referred to local law enforcement and the LGD for Weld County.

If an operator cannot access the resources without breaking the rules, then they have to cease activity immediately.   • Date Received: March 26, 2019 Document No.: 200447088 AIR QUALITY Operator: Invalid Operator Facility: Description: Location: DCP Midstream, Mewbourn Gas Plant, 18455 CR 35, Platteville, CO. 80651 Issue: One of their burn off stacks was emitting a lot of black smoke, usually you see big flames and small amounts of black smoke. This day there was much you could smell a foul odor in the air. Makes a person wonder what they do at night. Odor is described as "chemical", began on March 19, 2019. Residence is located 1.5 to 2 miles north of the source. Resolution: The location is not within the jurisdiction of the COGCC. The complaint was referred to the CDPHE Air Pollution Control Division.
  • Date Received: March 26, 2019 Document No.: 200447084 SPILLS Operator: Invalid Operator Facility: Description: On November 4th at approximately 8:00 AM my husband and I opened the door and were met with an overwhelming smell of gas. There are 5 ponds and a creek on our property, which are fed by the Animas Citizens Irrigation Ditch. In the early hours of November 4th, a 16 inch waste pipe broke and spilled the contents into the ACID which feeds/ flows through our ponds and creek. The first two ponds were especially hit with a tar-like black sludge, but all ponds were impacted, as they are flow through ponds. The ponds also have outlets that spread the contamination onto the surface of the property. The 16 inch line originates about 1 mile due north of our property. The operator (BP) is aware of the issue. Resolution: Please refer to REM #12660 for more information regarding operator's remediation activities. Sample results from April 2019 sampling are compliant with Table 910-1.

Using: Facilities/Well then entering Sec, Township, and Range I get the error message: error on server processing URL... and to contact administrator. I haven't had this problem ever before... Tried to access well logs in Sec 8, Township 5 South, Range 96 West several times and got the above mentioned error message. Before I had accessed and downloaded logs from this section, township, and range without any problem. Tried several other sections, townships, and ranges and got the same error message. Resolution: COGCC staff contacted the complainant regarding the issue and communicated they were aware of the issue and working on a resolution with the Office of Information Technology.
  • Date Received: Feb. 21, 2019 Document No.: 200446989 WATER WELL Operator: Invalid Operator Facility: Description: Every two years the oil and gas company who is drilling and pumping water/gas in the area of our home at 13980 Northridge Rd., Weston, CO, is required to sample our water well and normally provides us with the results. In December of 2017 Petrogulf was organizing the sample/ananlys but we never received a copy of the results. I understand the analysis / results are filed with the State of Colorado. How can I acquire a copy of those results. The last results we received were based on a December 2015 sample. Resolution: The operator provided Mr. Law's analytical results by mail, the COGCC also provided a PDF copy of the results by email. A Warning Letter #401948519 was issued to Evergreen Natural Resources regarding Rule 608.

But what I think is happening,this drilling on Lowry park is highly suspicious. I see permits exclusively issued and constantly approved on "Lowry" land. Why is that? State is benefiting from this activity and mineral right owner's outside this sacred area are getting nothing. Elbert Co to the south is right there and they are getting nothing from this activity. Mineral owners directly east of township 64 are being teased with permits with right on the edge of said township and yet nothing is leaving "Lowry park" I need a good answer as to why the "excluded" part's are being neglected. for the record I have a interest in rights in township 63w. And thus my concerns Resolution: Complainant was informed that oil and gas operators make decisions regarding where to drill, and apply for permits accordingly. COGCC reviews and approves permit applications in accordance with COGCC Rules.

My neighbor and I had both of our water wells quit working on Tuesday 2/12/19. His address is 3450 E. 156th Ave. We both have companies pulling the pumps but my neighbor's was test positive for gas in the well. I do not know of this is methane or natural gas. His company believes this may be the case of the wells not working. I believe you may have had a complaint from the previous owner Bob Harrison. Resolution: Samples collected for water quality analysis on 02/26/2019. There are no indications of any oil and gas related impacts to the subject domestic water well. The samples from the subject domestic water well did not contain the organic compounds benzene, toluene, ethyl benzene, or total xylenes (BTEX), which are often associated with contamination from petroleum hydrocarbons. Neither were total petroleum hydrocarbons (TPH), another method used to indicate impacts from petroleum drilling and production operations, detected.

You have an announcement on your homepage that says "Since January 18th, the COGCC has been experiencing IT issues with the electronic form submission and notification process. These problems have now been resolved. Acting Director Robbins has extended the comment period by 20 days for all affected permit applications." You opened the wizard comments up for a day because you acknowledged there were problems with the public's ability to add comments. Now the comment period for both of these huge proposed oil sites are closed and we cant add comments. We just read an article in teh Coloradoan yesterday which is how we found out about these proposed well pads and the Thornton pipeline that may be coming to Windsor too. URSA started trucking the production water from the Speakman pad to the Watson and the Tompkins injection wells in December and still are today. Battlement Mesa people are against the proposed injection well on the BMC A pad. Why don't URSA pipe the water from the B&V, BMC A and B pad to the BMC C pad(speakman injection well) around 5800' from the A pad. This would make the people of Battlement happier. solve URSA'S need for removing water without trucking and utilize the Speakman injection well. No, but Garfield County should be notified. When they permitted this injection well it was to reduce truck traffic. If URSA is trucking this water from the Speakman pad to another pad for injection (I followed the trucks to both pads) They are adding to the truck traffic. I'm sure this could be verified through there travelers. I would think that this water is from cradle to grave report. Sambrito Compressor Station Issue: We have been dealing with extreme noise issues with this compressor plant for months now. When it first went online years ago, it was extremely loud but they fixed those issues. Now it is extremely loud again and while they have done some things to address the issues, it is still extremely loud, especially at night. They have conducted sound tests and insist nothing has changed. Well, something has changed because the sound is not imagined. The one time the reps came out, the plant was apparently shut down or dialed way down so they acted like they did not believe us how loud it is. Now, I cannot get them to come out and they will not answer the last e-mail I sent on January 16th. Since it is a tribal compressor station, I am not sure if we have any recourse. They insist they follow COGCC rules to the T and way back when this was an issue, the problem was fixed. The person that took care of it was Terry Simpson and unfortunately, he since has passes away. We have been dealing with Bill Wilkinson and I have asked for any other person higher up I can deal with if this issue cannot be resolved at his level. He has thus far ignored that request. If the COGCC is unable to do anything to get somebody to address this use, is there anybody you can direct us to contact that might be able to resolve it? At times, there is little noise and at other times, the noise is horrible. I have never been around another compressor station that had these issues and there are many in our area. Surely there is some way to get this issue addressed. I know I am increasingly irritated and the person I have dealt with probably is getting frustrated with me but it is horrible. If you cannot do anything, perhaps you can please direct us to somebody higher in the Tribe with Red Cedar Gathering that we can speak with. We either need more time (120 days) to come to terms or the permit process should be terminated for them because they are not acting in good fait. Do not understand the notice letter no one is responding to my request for negotiated terms. This is a huge burden on ordanary 'real' citizens. The lease provided by Extraction is not fair. Attempts to contact the landman listed on the notification have gone un-answered. Contacts provided by a council member of Broomfield are not responding. I am attempting to address this issue in a reasonable manner, but nobody is responding. This is a huge burden on an ordinary real citizen without the backing of a Corporation or legal background. The county's real citizens have voted to ban fracking and they voted in support of Proposition 112. Unfortunately, the Oil & Gas industry has chosen to overrule the will of real citizens by spending vast amounts of money on legal fees and mis-information campaigns to make us ordinary citizens obsolete. This is even more of an issue as large corporations encroach on large suburban communities where land is fractured into very small lots. The landowners in these areas do not own large tracts of land, they don't stand to benefit from huge oil & gas windfalls, and they don't have any money to fight the large corporations. On the flip side, oil & gas corporate citizens are taking advantage of a 'divide & conquer' situation where the land they seek mineral rights to is fractured across many disorganized land owners. This is a huge windfall for the corporation and a failure of our government to protect and uphold the will of the REAL people. I own less than 1/3 of an acre of land. All of my neighbors are in the same boat. None of us has enough money to hire a lawyer to negotiate a fair and equitable lease with the predatory corporation. The royalties we are due for our share of the natural resources are miniscule on an individual basis, so the return on investment to hire a lawyer is non-existent. So what is a real citizen supposed to do? The contract that the oil & gas company is providing to real citizens is very predatory. There is no way I can sign their lease. Yet, I don't have enough legal experience to know how to negotiate this, and I don't have the time nor experience to run a huge community organizing effort to rally against the corporation. I have filed a complaint with the COGCC, but suspect that organization is just a front for corporate interests. The property address is 15211 Washington St., 80023. Issue: (1) A water well (owned by North Washington Water Users Association - NWWUA) on the property is contaminated, and has been since, at least, 1997. See COGCC Order No. 1-72 and 1-83; Hearings File Memo dated October 18, 2018 by John Axelson at Doc. No. 2303200. The water well is used by 52 individuals, including the property owner. Thermogenic gas has been identified in the water, but testing has not been completed for other contaminants, particularly liquid contaminants such as BTEX. The water is often discolored (brick red), viscous, smells of crude oil, gaseous, and flammable. (2) There is another water well (owner's personal well) located on the property that is also contaminated in similar fashion and requires testing. Water issues: Odor, Taste Change, Color Change, Deposits, Flow Change, Flammable DWR Permit #: 143702, 8994 Well ages: 1 is 32 years old, 1 is 60 years old Water use: Household Use, Livestock/irrigation Resolution: The domestic water well (permit #143702) had no evidence of any O&G impact (biogenic origin of methane present). The water sample from the Roberts tap from the NWWUA had previously been known to contain methane of a mixture of biogenic and thermogenic origins. The water tap owner was advised to address any concerns to the NWWUA and/or the CDPHE.

The Sharpe 1-10 well is 100 yards north of the property owner's personal well, and 150 yards west of the NWWUA well. Resolution: Under COGCC rules removal of any partially-buried produced water vessel must be closed under a Form 27 and this was accomplished at the Sharp 1-10 tank battery with work conducted June 2018. Clean-up action are detailed in supporting documentation for a NFA determination by the COGCC staff. After review that NFA determination was granted and remediation No. 11446 closed on 7/10/2018. Former site equipment has been removed and site is undergoing reclamation.

As indicated, this is a county road and it is not being maintained to this standard. The washboards that exist are dangerous as they make it nearly impossible to maintain control at any speed. In fairness, the county grades every couple of months, but the quality of the road is so bad two weeks later that a small automobile has trouble maintaining control. We call the county regularly and we're told it is on the list, but that the list is large. Meanwhile, drivers on county road 84 are at risk. Given the speed at which the roads deteriorate after grading and the amount of daily traffic on this road, it appears it should be paved. It is believed that Janice Smock is receiving benefits from this lease agreement, which is through 2020. The lease agreement was filed with Weld County records on 02/02/2017. I am also in possession of the lease and can provide via. email. Our desire is for the lease agreement to be terminated with both parties informed, due to the lessor not being listed on the deed. Great Western Operating Co had my home inspected by their engineer. He was astounded by the amount of heaving in the basement. We have photographic evidence, and testimony that the house was undamaged all through the new home warranty. They have offered 5000 dollars to go away and sign a release. Please help and advise. basement repair specialty company will be making a detailed inspection for the purpose of repairing my home on July 3rd 2018 Nature of damage: house Cause/ source of damage: seismic testing Resolution: COGCC has reviewed this complaint and the documentation provided by Great Western Operating Company LLC, Operator # 10110 (attached). COGCC Staff has also reviewed Rule 333 which regarding seismic operations. The pipeline construction area was just dirt and the heavy rains we recently had caused the water to flow across the access road to the other side of the access road, it was literally like a river flowing across the road and caused a significant amount of erosion to the road. This is our only way out to the county road. I would think the pipeline company would of had some storm water procedures in place. Operator: I believe the company is Cureton or Honeywell from what a neighbor told me. The pipeline was not actually installed on my property. The pipeline crosses under the access road. Resolution: Pipeline construction is not within COGCC jurisdiction, routed to LGD.

Conoco is planning to drill eight wells on this controversial location but is only proposing one well to the COGCC in order to avoid compliance with COGCC rules and closer scrutiny from local officials and emergency responders. Allowing applicants to propose fewer wells than they are ultimately planning in order to avoid COGCC requirements sets a terrible precedent and, if allowed, would mark a departure from COGCC policy that formerly required Operators to file Form 2A permits for all the wells they expected to need for full development of the resource. CRS § 34-60-121(2) states, “If any person, for the purpose of evading this article or any rule, regulation, or order of the commission, makes or causes to be made any false entry or statement in a report required by this article or by any such rule, regulation, or order, or makes or causes to be made any false entry in any record, account, or memorandum required by this article or by any such rule, regulation, or order, or omits or causes to be omitted from any such record, account, or memorandum full, true, and correct entries as required by this article or by any such rule, regulation, or order, or removes from this state or destroys, mutilates, alters, or falsifies any such record, account, or memorandum, such person is guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than five thousand dollars, or by imprisonment in the county jail for not more than six months, or by both such fine and imprisonment.” (Emphasis added) Conoco is not hiding its intent to falsify its application. It has been very forthcoming in public meetings and in speaking with members of the public that it sees the first well as “phase 1” of its project. Because there is no application in process, COGCC Staff sees no reason to pursue this matter any further. I had perfect clean water before fracking started in the area and now my water is bad. I did a test after a 24 hour flush and the test came back unusually high in irons, manganese, sulfers, and dissolved solids and arsenic... I talked to one of my neighbors and she is having the same issues with her water as well... I dont want to dive right into blaming fracking, However that is the only thing that has changed since the well was drilled. Well is 2.5 years old, permit number not known, well sample requested Resolution: COGCC completed a review of the analytical results for the water samples collected from your domestic water well on June 20th. There were no indications of any oil and gas related impacts to the subject residential water well.

The pipeline can be access through the walking path that begins in our neighborhood near Jasmine St and 167th Ave. Issue: There is a pipeline that runs through our neighborhood, mostly underground. There is an above ground access point in the NW of the neighborhood that is usually fenced off and secured. After the intense wind storm about a month ago, the fence was pretty destroyed, and pieces of the fencing, and other materials, spread throughout the walking path and natural area nearby. The above ground portion of the pipeline is exposed, and the debris needs to be removed. Resolution: COGCC Staff reviewed the location and determined COGCC does not have jurisdiction over the pipeline. The complaint information was relayed to the Brighton LGD and the Public Utilities Commission.

They informed me that they over paid on these wells, Gardner 11-32, Gardner 21-32, Gardner 13-32, Gardner 22-32R, Gardner 41-32B, Stone 32-1 and Stone 31-32. So they stopped any and all of my royalty payments on all of my wells which there is quite a few that I have royalties on. I believe that they should have recouped there over payment amount in the second month of nonpayment with some left over but I am now soon to go on 4 months with not one payment. Originally they said they had over paid by about $3300 and then later they changed that number to $3700. My monthly royalty checks averaged about $1800.00. As of the second month of nonpayment they told me that they had only recouped about $2000.00. With out the production statement that I usually receive I have no way to track what I should have been paid and what they have recouped. YOU DO THE MATH, SOMETHING DOESNT ADD UP. ,On Feb 2018 all royalty payments stopped with no prior notice or explanation. After waiting 2 weeks beyond payment date I began attempting to contact someone for an answer or reason. The first person I spoke with, after leaving numerous messages told me they would look into it. No return call was ever received. I had the phone number for a man I dealt with before, when the lease payment on a disposal well failed to be made. After speaking with him and days past, he called and told me they had over paid on seven of my wells dating back to 2014. He told me how much they needed to recoup from me. I requested monthly production records and royalty amounts to track the recouping process. I received information that dated back to 2014 and ended with month of the last royalty check I received. My last royalty check was Jan 2018 which would have been production for Oct 2017. The papers I received stopped at that month. After repeatedly asking for production records for Nov, Dec 2017 and Jan 2018, which would be for Feb, March and April 2018 royalty periods that were with held. Resolution: COGCC Hearings officer contacted the complainant and explained the payment of proceeds procedures and provided COGCC forms 37 and 38.

On 3-14-2018 at approx 1100 hrs I performed an inspection of the oil and gas operations in the area. At the time of the inspection I observed Haliburton fracking operation on the Kerr McGee RW 29N-29HZ location. I observed normal fracking operations on location during my inspection. All lighting on location appeared to be pointed down and toward the ground at the time of the inspection. I also observed exhaust coming off the fracking pumps during my inspection which is normal during fracking. The exhaust fumes observed are common in the fracking process and are not regulated by COGCC or CDPHE. I later spoke with Eric Wenzel of Kerr McGee he indicated the fracking operation has been operating under normal condition without any upset fracking conditions during the frack. On 3-9-2018, I attempted to make contact with the complaint. I performed a complete site inspection of the Verdad Homestead location. I reviewed location records, which did not show any abnormal fracking conditions at the time of the complaints. I reviewed third party sound records at no time did the fracking operation exceed COGCC rules according to the sound study information reviewed. The location is approx. 1.2 miles away from the complaints home. Due to the information and the proximity to the complaints home it does not appear the Verdad location was the cause of the complaints noise complaint. No violation of COGCC rules were observed at the time of the inspection of the frack operation nor in the surrounding neighborhood. Two people were killed and it was determined that a discontinued flow line which had been left open was the reason for the accident. Shortly after this explosion Kerr-McGee Oil & Gas Onshore LP/ Anadarko Petroleum Corporation turned the gas off to our residence. They cited the accident (State Moratorium) as their rationale for shutting our heat supply off and offered us $45,000 dollars for our oil and mineral rights. We declined their offer and simply asked for the gas to be turned back on. As oil and gas owners of the wells shut down our lease entitles us to one eighth of production to our residence. This lease has been in effect since April 3, 1970 and in the fifteen years that I have lived in my residence, there has never been a problem with the gas issued to our home. Last spring we received a letter from Extraction Oil stating they were considering drilling a horizontal well under our property and asking if we had any objection. We consulted an Oil and Gas attorney in Loveland and we determined that since they were not going to violate our surface rights we would not object and did not respond to the letter. In December Extraction Oil sent a registered letter to our bank rather than our PO box in Loveland stating that they were in the process of getting ready to drill and giving us 35 days to decide if we wanted to be willing partners, agree to a lease, or be force pooled. If we did not respond within the 35 days we would be force pooled. The letter was sent by Mr. Zaranka and stated that if we wanted a lease proposal we should email him. I sent an email on 12/11/2017 asking him to send their proposed lease to either our PO Box in Loveland or via my email. I have had no response at this point. I do not believe Extraction Oil in acting in good faith since they did not provide a proposed lease agreement leaving me with no choice but to be force pooled. Resolution: COGCC Hearings Officer Jim Rouse spoke with the complainant. Since filing the complaint, Extraction had provided a lease. Mr. Rouse explained forced pooling to the complainant. Complainant will assess options with his attorney and does not want to pursue the complaint further.

I called her today follow up on her complaint and see if she was still not receiving payment. She stated she has not received payment for two wells for approximately three years. I walked her through the Forms 37 and 38 process and learned that she does not have a computer. I next advised her that I would send her a letter regarding the next steps and include two copies of each of the Forms. I have attached a copy of that letter to this e-mail and consider this complaint closed.

It took about four or five months for my water to go back to the way it was before. I originally assumed it was a plum, but talking to my water treatment guy he said it very well could be from the removal of that old well. Resolution: There were no indications of any oil & gas related impacts in analytical results for samples collected from the complainant's domestic water well. Based on the results of this sampling, the complaint regarding potential impacts to ground water quality is being closed.

My father Raymond H Roark and my mother, Virginia J Roark were two of the original mineral right owners in the J Sands of the Adena oil field. They never sold their interest to the Monahan family nor the Breneman/Larrick family. Apparently those families have leases on the J sands and my parents were never issued a check nor did my parents ever sell their mineral rights. Their wills were filed with the court by their trust attorneys and all assets were transferred into my trust. The oil and gas conservation commission should not accept any documents from Betty and Woznack that perpetrate false documents and possibly cover a fraud on two old people. That spreads a crime of mail fraud/conversion and wire fraud which is possibly ongoing. We were notified by a purchasing title company that our mineral right ownership in the J sands is .004 when my father owned at least 1 1/4 interest in 2,000 acres of the original adena oil field in his trust. No one had the power to convey or lease that while my father was alive but apparently there are leases and they are still being paid instead of our trust. We have asked this operator for a lease and they have told us we are held by production even though there was a pooling in 2012. We have asked for one and the operator recognized the Breneman/Larrick/Monahan family and not us. We respectfully request that they include us on all communications and we are filing a complaint that they are paying their friends and not the rightful owner of the minerals which are held in our trust. Please help us recover this fraud. The statute of limitations on fraud in the state of Missouri is 10 years. We have an email from their title attorney that we own the minerals to pay someone else and keep actively paying them is fraud in the highest degree especially when it took a cash bonus and payments away from two elderly people in 2011 when they knew where my parents lived and they did not offer them a lease knowing t Resolution: Complainant was provided information previously supplied to them by a COGCC Hearings Officer: In response to your questions regarding non-payment of your royalties, you must start the process by submitting a Form 37 to receive any proceeds you may be entitled to pursuant to a lease or other agreement. Under the Payment of Proceeds statute 34-60-118.5, there is certain information which must accompany every payment of proceeds from oil or gas. However, please note that the Commission has limited jurisdiction under the Payment of Proceeds statute. Section 34-60-118.5 (5), C.R.S. states: [a]bsent a bona fide dispute over the interpretation of a contract for payment, the Oil and Gas Conservation Commission shall have jurisdiction to determine the following: (a) The date on which payment of proceeds is due a payee under section (2) of the section; (b) The existence or nonexistence of an occurrence pursuant to subsection (3) of this section which would justifiably cause a delay in payment; and (c) The amount of the proceeds plus interest, if any due a payee by a payor. If you are not successful in getting the information in that manner and the matter is not a bona fide dispute of contract interpretation, then you must file a Form 38 to have your application docketed if all the jurisdictional prerequisites have been satisfied. While use of Form 37, as opposed to an email format you have selected may not seem material, Commission experience is that use of the appropriate form significantly facilitates dispute resolution between private parties without invoking Commission jurisdiction, resulting in a more satisfying outcome for all parties. Issue: Project 2130 has shown that TBA contamination is real and a problem in many water wells around Las Animas County. This report contains no data to show that the possible source comes from any activity other than from gas drilling and extraction. It is true that there is no evidence to exonerate Pioneer natural Resources from responsibility. The opinions voiced by the COGCC and the oil and gas business but are not supported by any evidence. For instance, there is no explanation of where high levels of TBA in the Sachinator MW1 came from. The report does say that toluene found in the same well is human caused (by gas drilling and extraction). Opinions by the COGCC and Pioneer, as stated in the report, include that the source of contamination might be naturally occurring. This is not backed up by facts, data or evidence of any kind. Another opinion states that there is no evidence the the oil and gas industry is the source. That statement, however, is completely false. All evidence and data that has been presented, directly points to Pioneer as being responsible for the contamination of groundwater. This evidence is as follows: 1. Pioneer drilling equipment got stuck while drilling the Sanchinator well. 2. Pioneer in and effort to get the drilling string out of the hole, over-pressured the drill string and caused a communication of the drilled well borehole with the groundwater formations as evidenced by water well caps being blown off. In addition, it is highly likely that Pioneer spotted diesel or another man-made organic product in order to relieve the stuck pipe condition. This introduced the man-made organic contaminates into the groundwater. This is evidenced by high levels of TBA and other organics in the Sanchinator monitoring wells (greater than 1200 micrograms per liter) and in the Sanchinator production fluids. Therefore the communication between the production zone and the groundwater and the organic contamination in bot Resolution: Due to the similarity of issues described in the current complaint, lack of significant change in oil and gas operational activity, and previous history of compliance related to surrounding oil and gas operations, the COGCC has resolved and closed the current complaint with no further action pursuant to COGCC Rule 522.

On 2-5-2018 at approx 1500 hrs I contact the complainant who indicated he was experiencing noise coming from a location north of his home, he indicated it was pretty constant noise. I performed an inspection of the oil and gas operations in the area north of the complaints home. At the time of the inspection I observed several pumps jacks in the area but during my inspection of the area which lasted approx. 1 hr I did not hear any of the pumps jacks operate causing noise which the complaint was indicating. I later spoke with KPK operator and he indicated the pump jacks in the area were mostly manually run and did not run at night time. All information reviewed, and requested as well as site inspection information were submitted to the COGCC for further review. No violations of COGCC rules were observed at the time of this inspection

Fitzsimmons 18-9 & 3-9HZ pad (this one is directly across the street, south from my home), FL Mountain 13-4HZ pad (directly to my west), King 1-8HZ pad, Gabel 7-8HZ pad and FL Greens 18-8HZ pad. Issue: There has been at least 5-6 active site operations taking place along this stretch of road over the last year+, one of these about 500' from my front door and 3 others within earshot and sightline from my house. I also experienced a lowering of the shallow water table in the late summer that I suspected was caused by the drilling activity, causing damage to my home water shallow well pump and costing me $1300+, but Anadarko denied via a phone inquiry that their activity would create such a problem and I couldn't prove it. The Water Well company that serviced my domestic well indicated suspicion of drilling activity involvement in the lowering of the shallow water table as well. Resolution: Spoke with Mr. Powell by phone on 04-11-2018. The shallow well subject to his complaint (DWR Permit #204748) was constructed in 1930 and is less than 15' deep. The well is used on a seasonal basis to irrigate landscaping. Mr. Powell has observed lowering of the shallow water table on a seasonal basis in previous years. He was wondering if that could result from O&G drilling and production activities in the vicinity of the well. I explained that was highly unlikely and why. He was not interested in having his well sampled. He said he was satisfied with our telephone conversation and a letter repeating what we had discussed was not necessary

There was no location shown on the Division Order sent by Fifth Creek Energy Operating Company LLC They publish a hotline # which is 855-816-2357 which I called at least three times over the last 3 weeks. I left at least three message but no one returned my call. I called the main number and was transferred to a tech and explained what I wanted and after a week I called again and this time I left a message. No one has ever bothered to return my call. All I am trying to do is confirm the well location so I can verify my interest. It also appears there are two wells but I can only find one of the wells on the Colorado website. Resolution: COGCC staff contacted the operator (spoke with Land Tech) and made them aware of a complaint regarding lack of response to inquiry from Lemon Creek Oil and Gas LLC. COGCC suggested the operator contact the complainant. Follow up call with the complainant confirmed they received a return call from the operator and complaint issue was resolved.

I performed an inspection of the area around the Erie high school and the oil wells close to the school which were being plugged and abandon. The oil and gas operations in the area did not appear to have any gases associated with the P&A process as both wells had already proceeded to set plugs in the wells and did not have any pressure build ups. After checking the oil wells close to the school I went to the school construction site where I observed a hot tar operation at the school which appeared to be causing the odors in the area. All information reviewed and site inspection information were submitted to the COGCC for further review. No violations of COGCC rules were observed at the time of this inspection

Destroyed new silverware and leaves heavy white film on everything. Can't even wash cars causes more problems. Conco bottom,last year to year and half I contacted cooper who no longer works there and advised of bad water causing eyes to burn, salty, bitter, white film on on dishes and destroyed new silverware. They set up four corners to come out to test water and set the appt 3 weeks out. Box 4677 Englewood, CO 80155 I have called and left a message, but no one has returned my call. The amounts of the checks are never significant, but the irresponsibility of Kodiak is the concern. Kodiak continually takes their product, in this case gas, and does not pay the royalties for over 6 months. The checks (Ivar W. Larson and Donna M. Larson) received yesterday were for gas produced in 5/2017. The checks were written on 8/29/2017 and received in the US Postal Service 1/2/2018. We have also received checks in March for prior year's production although the amounts are included in the 1099 for the previous year. Resolution: Well Number#: Location #: 440176 Inspection Document #: 674200407 Complaint #200445029 Nature of complaint: Noise Field Inspector Actions: On 1-4-2018, I was contacted by complaint specialist Megan Adamczyk in reference to a noise complaint received for 1-4-2018 by the COGCC about possible oil and gas noise occurring in the Windsor area somewhere around the complaints residence. On 1-4-2018 I contacted the complaint who indicated he was experiencing a noise which he associated with reverberation coming from one of the wells in areas equipment. The complaint indicated the noise was very intermittent. On 1-4-2018 at approx. 1100 Hrs I performed inspections of the oil and gas operations in the area. At the time of the inspections I did not find any abnormal operation in the area which could be contributing to the noise experienced by the complaint. I contacted both Bayswater and PDC and advised them of the complaint and asked them to monitor their equipment. Due to the intermittent noise and not finding any noise source in the area no noise study was performed. All information reviewed and site inspection information were submitted to the COGCC for further review. No violations of COGCC rules were observed at the time of this inspection

It wakes us up every morning and it is a low humming sound. It is coming from the direction of Weld County Road 7. Resolution: Well Number#: Location #: 333163 Inspection Document #: 674200386 Complaint # 20044492 Nature of complaint: Noise Field Inspector Actions: On 1-2-2018, I was contacted by complaint specialist Megan Adamczyk in reference to a noise complaint received for 12-31-2017 by the COGCC about noise occurring in the Frederick Area east of the complainant’s residence. I spoke with the complaint who indicated she was experiencing a low humming noise which she believed was coming from the drilling location located approx. 1 mile to the east of her residence across I-25. On 1-2-2018 at approx 1100 hrs I performed a complete site inspection of the Crestone Sullivan location approx. 1 mile to the east of the complaints residence. During my inspection of the location I observed an Ensign drilling rig performing regular drilling operations on location. I observed Crestone had an approx. 25’ sound walls surround the location for sound mitigation. I spoke with Crestone staff who indicated they had been drilling in the area since 11-28-2017. Crestone indicated they had been performing normal drilling operation during the time of the complaints in the last couple of days. No sound study was performed at the time of the inspection as weather conditions did not permit it, wind speed were above 5 MPH. .All information reviewed and site inspection information were submitted to the COGCC for further review. No violations of COGCC rules were observed at the time of the inspection

Material is greyish brown in color and was very viscous causing it to spread out as it was dumped to cover an area of approximately 100 sq. ft. 6 to 12 inches thick. This occurred on December 20th or 21st as near as we can tell. Spill described as - Greyish brown material, very viscous and spread out when dumped to cover an area of approximately 100 sq. ft. 6-12 inches thick Resolution: Material was sampled and the analytical results Indicate that the material is not a hazard and is probably not related to oil & gas operations. The origin of them material is unknown. Summary letter and analytical report sent to the landowner.

All the wells that have gone up around us, in the last few years, and now the ground water that has tested positive for a cancer causing agent, is extremely scary. The neighborhood of County Road 17 between Roads 10 and 8, would appreciate our water being tested and to be sure that our water has not been contaminated with the Benzene. KPK requested a locate for a spill a couple weeks ago. The flow line spill was directly above our sewer main. When they excavated they did not find the broken line but crud oil was found in the bedding around the sewer pipe. All they did was fence the area and then left the site. They were at the site today but still have not found the broken pipe. There is ground water present and the oil is in the water. They have left the site again because they didn't have a vac truck available. We are very concerned how far the oil may have traveled through our bedding. Resolution: no indications or reportable spill were observed on multiple visits to the site. Small quantity of liquid hydrocarbons in water below historically abandoned flow line. HC were observed on first visit but subsequently removed from excavation by operator with vac truck. No impacts to groundwater quality persisted at the excavation subsequent to removal of less than one pint of HC on water. Flowline was subsequently capped by KPK even though they did not believe the line had been in use with their operations.

Issue: We observed what appeared to be water surrounding the well approximately two weeks ago. We have also noticed the well has not been operating recently. Yesterday, I walked over to the well and noticed what I had believed to be water was actually oil leaking around the entire well, and up all the way to the top of the well. JP Kauffman. I did contact the emergency number listed on the well, 303-825-4822, but do not remember the name of the person I spoke to. They did respond within 15 minutes to assess the situation, and immediately began working to remediate the spill by spreading topsoil over it. I am concerned that this oil leak may have spread into the water table and affected our well. Resolution: No impacts to groundwater quality from nearby oil and gas operations were observed in data obtained from sampling of water well. West side of road. Issue: 1. Truck traffic turning off and onto Highway 56 at County Road 3, Berthoud, CO. I have witnessed multiple trucks stopped at southbound County Road 3 at Highway 56 making a left turn to head east on Highway 56 start out and proceed to have 3 other trucks pull in succession behind the first truck completely impeding small vehicle traffic heading from Berthoud on Highway 56 towards County Road 3 - the cars and other vehicles are nearly brought to a stop by the continued flow of trucks pulling onto Highway 56 from southbound County Road 3 and am concerned this is an extreme hazard to traffic flow. This puts vehicles in danger and is not following traffic rules. As a commuter to work in Denver, it is nearly impossible to safely turn left from southbound County Road 3 onto eastbound Highway 56 from early morning to late afternoon. This is truly a very dangerous situation. 2. Trucks carrying loads of dirt are not covered with any kind of protective overlay to prevent objects flying out of trucks onto vehicles driving behind them (even at a long distance) - isn't this required to cover loads? These trucks often travel at highway speeds and again present a danger to vehicles. 3. Road conditions (dirt road) have been extraordinarily poor north on County Road 3. Yesterday, the lane heading north on County Road 3 near the entrance to the well site was deeply rutted and impassable - had to pull into "wrong" lane to get through. Approximately, 2 weeks ago Ojo Springs Drilling (Walsenburg) was drilling to deepen our well when at approximately 400 ft a pocket of oil was hit. We had to drill down further for water and hit water between 1400-1600 feet. Per Ojo Springs Drilling, it appears that the oil is sweet crude oil, however, we would like to get the oil tested to determine quality and ensure that our current well isn't contaminated as we have animals that we supply water to. Resolution: There are not active or historic oil and gas wells within 3 miles of the complainants water well. Source of oil in the complainants well is believed to be naturally occurring. Historic oil wells drilled in the area of the complainants water well encountered the Niobrara formation at similar depth to the screened interval of the complainants water well. Complainant informed of need to treat water from well before using for irrigation, livestock or human consumption.

Keenesburg, Colorado Issue: In 2015 EPI Group US Inc. (Anadarko) did seismic test on my land and I believe that they damage my water well. I filled a complaint with them and all they did was pay me $925.25. I've had several drilling companies tell me they believe that the seismic test damaged the cement job and that I'm getting contaminants from other formations. With in days after the seismic testing we seen our beautiful clear water turn black. we tried flushing it out by running it 4-5 hours at a time. We call well service companies and they tried flushing it out with no luck. Since then we had to install an Iron Oxidizer and UV light and we still have issues with our water. We have spent $1000's on this and now we're just going to bite the bullet and drill a new well ($40K +).We're just tied of dealing with having to change out filters all the time, adding salt to the Iron Oxidizer. We buy the salt by the pallet now. My wife can't wash her hair in the shower water because it ends turning it red or orange in color. Water concerns: Odor, Taste Change, Color Change, Deposits, Flow Change Well use: Household Use, pets and some livestock Well age: 14 yrs Permit: #247351 Resolution: Water quality sampling results did not show any O&G related contamination. Stamp (deceased October 15, 1990) and LeNeita J. Stamp (deceased January 31, 2001) owned retained mineral interests in land in Weld County, Colorado. (County Line Road #1) As the representative of each of their estates, I contacted our lawyer and had the interests transferred to myself, Alleta (Stamp) Baltes, and my siblings, Linda Sundberg, Robert Stamp, Jeff Stamp, and Amy Stamp. I notified Rod Herring, CEO of TOP Petroleum, the holder of the leases. TOP sent us $8 each for August 2017 production. TOP has failed or refused to pay royalties on the mineral leases from 1983 on. TOP made no effort to contact any of us over all of these years or to pay into the State of Colorado Unclaimed Property Fund. (Jeff & Bob Stamp live in the Longmont area, Amy is also close by). We learned of our interest because of the diligence of Cub Creek Energy, LLC and its pooling application, Cause No. 407, Docket No. 171200881. Additionally, several offers have come in to purchase our mineral interests on the 12 acres. TOP refuses or fails to pay us the accrued royalties that are owing, which according to records filed with the State of Colorado should be approximately $8000 to each of us. Calculations on the amount owed were done as follows: The monthly production from 1983 to 2017 on the Stamp 31-2C well. FYI--The Codell was brought on production in 2009. The J Sand has produced from 1983 - present. Monthly prices of oil and gas back to 1983 from the Energy Information Administration and from Inflationdata.com where the EIA did not have data. I calculated the $ from Oil/Month and $ of Gas/Month. I used the NMA of 2.878, Royalty of 12.5%, and Spacing Unit of 320 Acres for the J Sand and 80 Acres for the Codell to calculate the Mineral Interest for each family member. I then deducted taxes (Ad Valorem, Severance, Conservation Levy) of 12.7% as Rod Herring mentioned in his email. The money owed above is what I came up with after the deductions. SW 1/4, NW 1/4, Section 33, Twp 1S, Range 64W, 1849 ft from N Sec line and 623 ft from E section line. The well was originally owned and operated by AMOCO but is now owned by BP. Issue: Benzene. In recent tests done on our water well, Benzene was found to be present in our water well at a rate of 9 PPB, almost twice the legal limit for drinking water in the State of Colorado. Well permit #: 269807 Well has been in use 11 years. Well use: Household Use, Livestock/irrigation Resolution: COGCC staff has reviewed the prior complaints (#200095139 filed in 2006 and #200412560 filed in 2014) and the final resolutions for each complaint. In addition, staff has reviewed the November 7, 2017, letter from Hirsch-Gibney, LLC. Based on review of this information, COGCC has determined there is no basis for additional investigation and has closed the current complaint. Staff has determined that the location where the complainant experienced the odor is not in immediate proximity to an oil and gas location regulated by COGCC; and is closer to other potential sources of petroleum odors, such as the King Soopers gas station immediately adjacent to the store. Based on the location, the concern is more appropriate as a regional air quality concern, over which COGCC does not have jurisdiction. The primary authority for regional air quality is the Colorado Department of Public Health and Environment (CDPHE) Air Pollution Control Division (APCD).
